Terms of Service

These Terms of Service ("Terms") govern access to and use of MV Creator, including its singing, photo, slideshow, lyric, image, and character tools; accounts; Credits; trials; subscriptions; downloads; and related services (collectively, the "Service"). MV Creator is independently operated ("MV Creator," "we," "us," or "our").

By creating an account, purchasing Credits, starting a subscription, uploading media, submitting a generation task, or otherwise using the Service, you agree to these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 18 years old and legally able to enter into a binding agreement. You must provide accurate account and billing information, keep your login credentials secure, and report suspected unauthorized access through the support channel shown in the Service.

You are responsible for activity performed through your account. Accounts, trials, and Credits may not be sold, transferred, shared to avoid limits, or used to bypass enforcement. If you use the Service for an organization, you confirm that you have authority to bind that organization.

2. The Service

MV Creator provides several managed creation workflows:

• Singing videos: combine an image or character with a selected audio passage to create a lip-synchronized performance.
• Photo videos and slideshows: combine images, audio, titles, subtitles, lyrics, transitions, countdowns, or visualizers into a downloadable video.
• Lyric videos: combine audio with recognized, imported, or edited timed lyrics and a selected visual template.
• AI images and characters: create optional artwork or character images that may be used in a separate video task.

Current features, supported inputs, file and duration limits, aspect ratios, trial availability, Credit costs, and output options are shown in the relevant workspace or Pricing page. Image or character generation is charged separately from video generation. Generating a task again creates a new task and may create a new charge; downloading an existing result does not consume additional Credits.

We may improve, replace, limit, or discontinue features. Where reasonably possible, we will provide notice before a material change adversely affects a paid Service, unless an urgent legal, security, safety, or provider issue requires immediate action.

3. Your Inputs and Results

You retain ownership of images, artwork, character media, audio, lyrics, subtitle files, prompts, and other material you submit ("Inputs"). You grant MV Creator and its service providers a limited, non-exclusive, worldwide license to host, copy, transmit, decode, process, synchronize, modify, and store Inputs only as needed to operate, secure, support, and provide the requested Service.

You confirm that you own the Inputs or have every license, consent, and permission needed to use them. You are responsible for clearing rights for recordings, compositions, lyrics, performances, voices, faces, photographs, artwork, trademarks, and any person appearing or heard in an Input. You must not upload or generate content that infringes copyright, privacy, publicity, contractual, or other rights.

MV Creator does not claim ownership of results created for you. Subject to these Terms and applicable law, you may use your results for personal or commercial purposes, but you are solely responsible for confirming that your Inputs and intended use are lawful. AI and automated media systems may produce artifacts, timing errors, inaccurate lyrics, unexpected movement, or content similar to material created for others. We do not guarantee that a result is unique, eligible for copyright protection, or free of third-party claims. Review every result before publishing, distributing, licensing, or using it commercially.

4. Consent, Identity, and Synthetic Media

You may not use the Service to impersonate, deceive, defame, harass, exploit, or misrepresent another person. Before uploading or animating a person's face, voice, likeness, or performance, you must have all permissions required for that use. You must not present synthetic or altered media as authentic when doing so would mislead people or violate applicable law.

Where applicable, you are responsible for disclosures, labels, permissions, and platform rules governing AI-generated, lip-synchronized, or edited media. The Service is not a substitute for legal advice about publicity, voice, music, copyright, advertising, or disclosure rights.

5. Acceptable Use

You may not use the Service to:

• upload, generate, or distribute content you do not have the right to use;
• violate copyright, trademark, privacy, publicity, data-protection, music-licensing, or other applicable law;
• create non-consensual intimate content, sexual content involving minors, exploitative content, or unlawful violent content;
• impersonate a person, misrepresent consent, facilitate fraud, or create deceptive political, financial, medical, or identity content;
• upload malware or content intended to disrupt, probe, or compromise the Service;
• evade usage limits, trials, safety controls, billing, or account restrictions;
• automate abusive requests, scrape the Service at scale, reverse engineer protected parts of the Service, or resell access without permission; or
• interfere with the Service or another user's access to it.

Providers may apply automated safety review to Inputs and results. We may reject a task, remove content, restrict features, suspend or terminate an account, preserve evidence, or report unlawful activity when reasonably necessary to enforce these Terms, comply with law, or protect users and the Service.

6. Credits and Trials

Paid creation tasks consume Credits according to duration, task type, and other pricing factors shown before submission.

• Free-plan Credits are added monthly, expire 30 days after issue, and do not roll over.
• Monthly and annual plan Credits are added monthly, expire 30 days after issue, and do not roll over.
• Credits purchased in a one-time package expire 360 days after purchase.
• Subscription Credits are consumed before one-time purchased Credits.
• Credits have no cash value, are non-transferable, and cannot be redeemed except through an approved refund.
• Free photo-video and lyric-video trials are limited as shown on the Pricing page and do not reset monthly. A trial restored after a confirmed technical failure is not a new recurring allowance.
• When a task fails or is canceled for a confirmed technical reason, the Credits charged for the failed task or failed item may be returned automatically. Dissatisfaction with a successfully completed result is not a technical failure.

Displayed estimates may be updated before final submission when the selected duration, task type, output, or price changes. We may correct a balance affected by fraud, duplicate fulfillment, technical error, refund, or payment reversal.

7. Subscriptions and One-Time Purchases

MV Creator offers monthly and annual subscriptions and may offer one-time Credit packages. Plan benefits, Credit allocation, billing interval, price, currency, and expiration are displayed before checkout.

By starting a subscription, you authorize Waffo Pancake to charge the displayed price automatically at each monthly or annual renewal until you cancel. You can cancel future renewals through available account or billing controls or request help through the support channel shown in the Service. Cancellation normally takes effect at the end of the current paid billing period and does not automatically refund that period. Credits keep the expiration date assigned when they were issued.

A one-time Credit purchase does not create recurring charges. One-time Credits remain separate from subscription Credits and are not canceled when a subscription ends, but they remain subject to their 360-day expiration.

8. Prices, Payments, and Refunds

Prices and currencies are displayed before purchase. Applicable taxes or fees may be calculated at checkout. Waffo Pancake processes MV Creator payments and billing details under its own terms and security controls. MV Creator does not store complete payment-card numbers or card security codes.

You confirm that you are authorized to use the submitted payment method. If a payment is declined, reversed, overdue, disputed, or fraudulent, we may withhold Credits, suspend paid benefits, or correct the affected balance.

Refund eligibility and request instructions are described in our Refund Policy and remain subject to mandatory consumer law. If you believe a charge is incorrect, contact support with your account email and transaction reference so we can investigate.

9. Third-Party Services and Privacy

Creation workflows may transmit Inputs, time-limited download links, prompts, settings, and technical request data to third-party image, video, transcription, storage, or workflow providers. Authentication, payments, hosting, email, security, analytics, and other operational functions may also depend on third-party providers.

Our Privacy Policy explains how uploaded media, results, task history, account information, payment records, analytics, and support information are handled. Third-party services are also governed by their own terms and privacy practices.

10. MV Creator Intellectual Property

MV Creator's software, interface, branding, templates, text, designs, and other Service materials, excluding your Inputs and results, are owned by or licensed to MV Creator. We grant you a limited, revocable, non-transferable right to use the Service in accordance with these Terms. You may not copy, resell, sublicense, decompile, interfere with, or create an unauthorized interface to protected parts of the Service.

To report an alleged rights violation, use the support channel shown in the Service and identify the protected work, affected content, your contact information, and the basis for your claim.

11. Availability and Output Disclaimer

The Service is provided on an "as available" and "as is" basis to the extent permitted by law. We do not guarantee uninterrupted availability, successful processing, accurate transcription or timing, exact lip synchronization, preservation of every visual or audio detail, a particular aesthetic result, uniqueness, compatibility with every platform, or fitness for a particular professional or commercial purpose.

Processing depends on your files, selected settings, storage, networks, workflows, and third-party provider availability. Keep independent copies of important Inputs and download results you wish to retain.

12. Suspension and Termination

We may restrict or terminate access for a material or repeated violation of these Terms, fraud, payment abuse, security or safety risk, unlawful conduct, infringement claims, or a legal requirement. You may stop using the Service at any time and may request account deletion through support.

Provisions concerning payments, ownership, disclaimers, liability, disputes, and enforcement survive termination where their nature requires it.

13. Limitation of Liability

To the maximum extent permitted by applicable law, MV Creator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, lost media, reputational harm, claims arising from your publication of a result, or business interruption arising from the Service. MV Creator's total liability for a claim will not exceed the amount you paid to MV Creator during the 12 months before the event giving rise to that claim.

Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

14. Changes and General Terms

We may update these Terms to reflect changes to the Service, providers, pricing model, law, or risk controls. We will update the date above and, for material changes, provide reasonable notice through the Service or account email when reasonably possible. Continued use after the effective date means you accept the revised Terms.

These Terms and the policies incorporated into them form the entire agreement regarding the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. Applicable mandatory consumer laws remain in effect.
